    A worker injured at work awards AED 250,000 as compensation

    A construction worker injured on the job will be awarded Dirhams 250,000 in compensation.

    The Abu Dhabi Court of Appeal upheld the judgment of the trial court and ordered the employment agency to pay compensation in cash.  The worker's right leg was amputated after a water pipe fell during work.

    The Asian worker had filed a lawsuit against the company and sought damages of Dirhams 4.3 million. One of the underground pipes for water fell on his feet. He was admitted to the hospital for treatment. Then his right leg was amputated. The worker alleged that the company did not provide necessary safety measures at the workplace.

    The firm argued that the plaintiff suffered injuries as a result of his own negligence and was therefore not entitled to compensation.

    But the company had filed an application seeking dismissal of the case against them as the worker was outsourced from another company and they were obliged to provide him with safety and security measures.

    The investigation confirmed that there was negligence on the part of the company and that the workers at the site were not provided with the necessary safety and security measures.

    After hearing arguments from all parties, the Court of First Instance ordered the worker to pay Dirhams 250,000 as compensation for damages. 

    However, the firm challenged the appellate court judgment which upheld the lower court's verdict. The court also ordered the construction firm to pay the worker's legal expenses.
